In order to maintain our system integrity and resources we expect our customers to act responsible. When you use any of Web Empowerment Solutions services and/or products, in any form, you automatically agree to the following Conditions.

1.) Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.


2.) Content

All services provided by Web Empowerment Solutions may only be used for lawful purposes.
Examples of unacceptable material:
Copyright infringement, phishing, Spam, unsolicited e-mailing, IRC Bots, Warez Sites, Pirated Software, Hate sites, Cracking or Hacking programs and archives, No child abuse and child pornography (Strictly Prohibited; violations will be reported to the appropriate law enforcement agency)
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice.
Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via troubleticket/email and will have a response within 48 hours.


3.) Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email abuse@webempowermentsolutions.com with the information required. If the request is of a licensing issue, we may require further documentation.
Web Empowerment Solutions reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. We also reserves the right to make any such modifications in an emergency at our sole discretion.
Web Empowerment Solutions reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Web Empowerment Solutions. All rights reserved.


4.) Payment Information

You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify Web Empowerment Solutions of your desire to cancel any or all services received, those services will be billed on a recurring basis.
We reserve the right to change the monthly payment amount and any other charges at anytime.
All accounts are set up on a pre-pay basis. All pricing is guaranteed for the term of pre-payment.
We reserves the right to change prices at any time, unless other terms have been agreed upon. Any account not brought current within a week (7 days) of e-mail notice or exceeding this time frame in any way is subject to suspension. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies us in writing for a request for termination of services.


5.) Backups and Data Loss

Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.


6.) Cancellation and Refunds

We reserve the right to cancel the account at any time.
Customers may cancel at any time. We give  you an unconditional 30 day money back guarantee on all our hosting solution's. Refund requests after 30 days will be refunded on a prorated basis of any unused time.
Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.


7.) Resource Usage

Users may not initiate the following:
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
e) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc


8.) Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.


9.) Money back Guarantee

On dedicated servers, and colocation no full refund will be honored, the 30 day money back guarantee does not apply. We reserve the right to refund a prorated amount or no refund at all.


10.) Indemnification

Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any  liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with our servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from any of our servers.


11.) Disclaimer

You warrant, represent, and covenant to Web Empowerment Solutions that (A) you are at least eighteen (18) years of age; (B) you possess the legal right and ability to enter into this agreement; (C) you will use the services only for lawful purposes and in accordance with this agreement and all applicable policies and guidelines; (D) you will be financially responsible for use of the services; (E) you have acquired or will acquire all authorization(s) necessary for hypertext links to third-party web sites; (F) you have verified or will verify the accuracy of materials distributed or made available for distribution via the services, including, without limitation, your content, descriptive claims, warranties, guarantees, nature of business, and address where business is conducted, and (G) your content does not and will not infringe or violate any right of any third party (including any intellectual property rights) or violate any applicable law, regulation or ordinance.
We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.


12.) Disclosure to law enforcement

Web Empowerment Solutions may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will co-operate fully with law enforcement agencies.


13.) IP Addresses

Web Empowerment Solutions maintains control and ownership of any and all IP numbers and IP addresses that may be assigned to the CUSTOMER and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.


14.) Domain Names

As part of the Services, you will provide WEB EMPOWERMENT SOLUTIONS with a registered domain name or names or WEB EMPOWERMENT SOLUTIONS will register such domain name(s) selected by you, provided that such domain name is available for registration and does not violate any registrar's policies, or any law or regulation. In the event of any dispute or cause of action arising out of or related to your domain name used in connection with the Services, upon your request WEB EMPOWERMENT SOLUTIONS will attempt to register with the registrar an alternative domain name chosen by you. You agree to be bound by the terms the registrar's then current domain name policy and/or the policies of the national DNS registration authorities to which you become subject upon registration of a domain name. The inability to use a domain name shall not entitle you to a refund by WEB EMPOWERMENT SOLUTIONS of any fees paid with respect to the registration of such unusable domain name. There is no charge for indefinite parking of domains on WEB EMPOWERMENT SOLUTIONS servers or to transfer to another service provider. However, in the event a domain that was registered by WEB EMPOWERMENT SOLUTIONS is transferred to another service provider, and requires manual intervention by WEB EMPOWERMENT SOLUTIONS support staff to complete the transfer, there will be an administrative transfer cost charged for each domain plus applicable taxes. Domain name payments are non-refundable. Once a domain name is registered, the WHOIS database stores the information and is kept there for a period of one year, until the date of renewal. You are responsible for spelling a domain name correctly while registering it online. WEB EMPOWERMENT SOLUTIONS will not provide refunds or credits for misspelled domain names.


15.) Miscellaneous Components

You acknowledge that the Services do not include, without limitation, content design, development, FTP master maintenance, uploading and publishing, Common Gateway Interface scripts and other such executables and that all of the foregoing are your responsibility. You may not compile or install binary files other than the ones provided by WEB EMPOWERMENT SOLUTIONS. WEB EMPOWERMENT SOLUTIONS does not make C compilers available and the PERL binaries provided will not have networking support (for example, socket ph, ftp.pl, etc.) You may use ftp to access your home directory for the purpose of installing and editing your web pages.


16.) Violations

We may, but need not, give you notice of suspension or termination for a suspected Violation of any of our policies.
We also reserve the right to remove materials from your web site at any time if we determine in our sole discretion that such content or materials violates our policies or this service agreement. Your pre-payment of your accounts that is terminated due to our determination of a violation of one or more of our policies will not be refunded. You agree to pay to us our costs, including reasonable attorney fees, incurred as a result of our investigation and/or defense of any third party claiming that your Web site violates or infringes on their rights. We have the right to require pre-payment of such fees. We are, however, under no obligation to conduct any investigation and may, if we choose, terminate your service upon receipt of such third-party claim or upon our own action. In the event of a termination of services, your files and data stored on our computers will be deleted after such termination.


17.) Changes to the Terms and Conditions

Web Empowerment Solutions reserves the right to revise its policies at any time without notice.
